The State of New Jersey owns in fee simple all lands that are flowed by the tide up to the high-water line and claims ownership of those formerly flowed tidelands as delineated on the Tidelands Claims Maps.

In New Jersey, the Public Trust Doctrine recognizes and protects natural resources as well as recreational uses such as bathing swimming, sunbathing, and walking along tidal waterways and their shores.

The common law Public Trust Doctrine protects sovereign lands, such as tide and submerged lands and the beds of navigable waterways, for the benefit, use and enjoyment of the public.

The general rule is that the State of New Jersey holds title to all lands now or formerly flowed by tidal waters.

New Jersey law enforces the Public Trust Doctrine, which ensures that the state retains ownership of its tidal waters and adjacent shorelines for public use. State ownership extends to the mean high water mark, which is the average line on the shore established by the fluctuations of the tide.

A riparian grant is a deed from the State of New Jersey for the sale of its tidelands, also known as riparian lands. As stated in N.J.S.A. 12:3-10 and N.J.S.A. 13:1B-13, state- owned tidelands are defined as all lands currently and formerly flowed by the mean high tide of a natural waterway.

Requirement of Trusts

Private facilities are found everywhere in New Jersey, including single-family homes, farms, multi-family housing units, industrial areas, trailer parks, shopping centers and sometimes in the road right of way.

Under the New Jersey Trust Fund Statute, there is no trust until the money is “paid” by the owner. In other words, there is no trust in money held by the owner and a creditor-beneficiary has no claim against an owner.

Eminent domain refers to the power of the government to take private property and convert it into public use, referred to as a taking. The Fifth Amendment provides that the government may only exercise this power if they provide just compensation to the property owners.

Some states, such as Hawaii, Illinois, and Florida, have amended portions of their state Constitution to include the Public Trust Doctrine. As the Court noted in Illinois Central, a state may convey title to submerged lands if the conveyance is consistent with the Public Trust Doctrine.

Giving ownership or rights to an individual would infringe on the public's right to access and use the resource. The public trust doctrine was inherited by the England's legal system, and emerged in 1215 as part of the Magna Carta, the document which sought to limit the power of the king.
